Please read these Terms of Service ("Terms") carefully before using BrandPing.ai ("the Service"), operated by BrandPing.ai ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

BrandPing.ai is an AI brand reputation monitoring service that tracks how AI assistants (including ChatGPT, Claude, Google Gemini, and Perplexity) represent your brand, and delivers alerts when significant changes are detected.

The Service is intended for business use by founders, marketers, and brand managers. It is not intended for consumer use in monitoring personal reputation.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account and all activities that occur under it. You must provide accurate information and keep it updated.

You may not share your account with others, create accounts using automated means, or use the Service on behalf of others without their authorisation.

3. Acceptable Use

You agree not to:

• Use the Service to harass, defame, impersonate, or unlawfully target any individual or business, or to monitor the personal reputation of a private individual
• Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use
• Violate any applicable laws or regulations
• Attempt to circumvent any security measures of the Service

4. Pricing and Payment

Certain features of the Service require a paid subscription. Pricing is shown in the mobile application and varies by country. All payments are processed through Apple App Store or Google Play. Subscription terms, billing frequency, and cancellation policies are governed by the respective platform's terms.

Subscriptions automatically renew for the same term unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings.

We reserve the right to change our pricing. We will provide reasonable notice of any price changes through the app.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by BrandPing.ai and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on the Service without our express written permission.

Your brand configuration data (brand names, competitor names, industry descriptions) remains your property. You grant us a limited licence to use this data solely to operate the Service on your behalf.

6. Disclaimers

The Service provides monitoring and alerting based on what AI models return at the time of scanning. We do not control what AI models say, and we cannot guarantee that monitoring will detect every relevant change or that alerts will be delivered within any specific time frame. See our Privacy Policy for details on which AI providers receive your brand data to generate these results.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BrandPing.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless BrandPing.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time through the app settings.

10. Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms shall be resolved through binding arbitration or the courts of competent jurisdiction, depending on your location and applicable law.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
